Terms of Service

By Ordering a Commission. Custom Design, or Purchasing an Adoptable from me, Ink-Eo, Eo, Eonova, N9ne, N9ne-Designs, or any variation henceforth, henceforth noted as Commissioner, you, the Customer, agree to the defined Terms and Conditions written and displayed herein, but not limited to potential changes on a Case to Case basis. If you do not agree with ANY of the following Conditions or Definitions, do not proceed with the purchase/order of a Commission or Adoptable. If you proceed forward by Purchasing a Commission or Adoptable you agree that you have thoroughly read and understand all of the Terms and Conditions outlined below.

My Art, Commissions, or Designs are not to be used for NFTs or anything of that, or Commercial, nature. If you are found to be redistributing my work for Commercial use, you will be immediately added to a Ban list and will be unable to purchase from me in the future..

No refund will be provided and any Commission or Custom Design will be halted immediately should these terms be voided.

The Basics

The Commissioner retains all Rights to Refuse a Customer’s commission order, and will do so if the requested commission is not something they will enjoy or are interested in. Do not take this refusal personally.All commissions will be drawn within the parameters of the Commissioner’s style, which may change where is applicable, and is dependent upon the commission requested. The Commissioner will NOT be replicating another’s style, be it another Artist, Animation, Movie, Game, or Cartoon. Designs will not be heavily referenced solely off of another’s singular design or any one character from Games, Movies, or Shows in the same respect.

When ordering a commission, please specify if there is a desired pose and/or setting, or if Free Reign is to be granted to the Commissioner.

>> ^{If the Customer chooses the pose and/or setting, send references of the desired options.
Please be sure to include the necessary images when the Order is placed.}
>> ^{Following the specification of Free Reign, there will be no option to edit the pose or setting, only details of the Customer’s character will be allowed to be altered when the initial sketch is shown for approval.}
>> ^{A sketch will be provided to allow for any edits to be made once started. Another WIP will be provided at the halfway point (50%) to allow for any further tweaks that may be needed. After, the commission or custom will be completed with no further WIPs will be shown unless requested.}

The Customer is allowed to cancel the commission at any time, and request a refund. However, refer to the following to better understand the limits and conditions of a termination of order:

>> ^{If a commission or design is canceled, and a refund is requested, only Half(50%) of the Paid Amount will be returned.}
>> ^{Any commission or design that has come outside of a Sketch will not receive refunds. No matter the reason.}
>> ^{If the commission or design is nearly completed but not to the Customer’s liking, and a refund is requested, the Customer’s request will be DENIED, as there will have been ample opportunities given to adjust the Order to your liking.}

Design inspiration for custom adoptables must be provided if the Customer has any, whether it be a short description of personality, or few to multiple images, or even some physical traits this character may possess. This will make the process easier for both parties, and will likely result in greater satisfaction.

>> ^{If the design of the custom is decidedly free reign, this must be stated when placing an order. However there are still some requirements, as listed.}
>> ^{Species, gender, and at least ONE trait.}

Custom Design Commissions will receive more updates and available edits than Illustrative Commissions due to the nature of what they are. A Custom design will need more input from the Customer to ensure that the vision is as close as possible to the given idea.

>> ^{Updates may be requested at any time, however this does not mean that edits will be allowed.}

WILL DRAW

>> ^{Humans/Humanoids, Anthros, Ferals, Creatures, Closed Species, etc.}
>> >> ^{The Commissioner will draw just about anything, even if there are no examples of them.}
>> ^{Armor, Machines, Weapons, Guns, Cybernetic & Mechanical}
>> ^{Gore, Blood, Drug Use, Alcohol, Violence}
>> ^{Tasteful NSFW and Nudity}
>> >> ^{The Commissioner may not take these types of Orders on a regular basis.}

WILL NOT DRAW

>> ^{Inappropriate Interactions and Fetishes, Filth}
>> >> ^{Note the Commissioner if clarification is needed.}
>> ^{Human(oid) children or babies}
>> ^{Cartoony-Styles (IE. if you're looking for something like MLP, Steven Universe, Sonic.. Etc etc)}

Adoptables

>Adoptable Designs fall under two categories; Flat Sale, and Auction.
>Payments for Adoptable Designs, both Flat Sale and Auction, must be received within 48 hours.

>> ^{If payment is not received in the allotted time, the Design will be placed back on market.
Holds can be discussed on Adoptables over 150$
However, if after the holding period that was requested the payment is still yet to be received in full, 50% of what was paid will be refunded, and the Adoptable will return to the market.}

>Do not harass the Buyers or Winners of any of the Commissioner’s adoptables; be it auction or flat sales. Do not behave inappropriately if you do not claim the design first in the case of First Come, First Serve. Do not complain or cause drama if you lose an Auction.

>> ^{Any Instances where the above is found, the result will be a permanent ban from purchasing any design in the future.}

Small edits can be requested to be done to the design by the Commissioner.

>> ^{IE; slight color changes, marking tweaks and/or additions, gender.}

>After purchasing an Adoptable All Rights go to the Owner. You are allowed to change anything so long as the Design still at least resembles the one you purchased.
>Do not claim the base design or art purchased as your own.

>> ^{You may reupload the purchased design so long as the Commissioner is given proper credit.}

Do not resell the base Adoptable for more than the value purchased.

>> ^{This changes if the Customer has acquired other art of said Adoptable. Monetary value can reflect accordingly.}

>If the Design is purchased as a Gift, please make sure to inform the Commissioner during the purchasing process.
>Designs may be re-gifted.

Flat Sales

>All Flat Sale Adoptable Designs are First Come, First Serve.

>> ^{This means that the Customer who claims the design first, will be Contacted and payment will be requested.}
>> ^{If Payment is not received within 48 hours, the adoptable will be placed back up on the market.}

Auctions

>All Auctions will run for a single(1) week, and will officially close 24 hours after the last bid has been placed as a snipe prevention window.

>> ^{The winner of the Auction will be Contacted after such time. And payment will be requested.}
>> ^{If payment is not received within 48 Hours, the adoptable will go to the next highest bidder.}

Commissions

>You may use commissioned artwork for personal use only. Credit to me is always required.

>> ^{Do not use any commissioned work for Commercial purposes.}

>When ordering a commission from me, while I do allow you to post the completed watermarked piece to your own account, you may not post the full resolution, unwatermarked version of the artwork to any social media and/or art sites, (including dA, fa, twitter, tumblr, etc).

>> ^{I reserve the Right to post the Full Resolution to any site or social media I maintain.}
>> ^{You may post the full resolution to private, and/or personal character profiles and pages.}
>> ^{If you have your own watermark that you use when uploading to your accounts, you may not use it if it covers my signature or blocks my own watermark.}

>The minimum timeframe I ask to be allotted when a commission has been ordered is 1 Month or 4 weeks.

>> ^{Commissions will likely be completed in a smaller time frame, but in the chance that life gets ahead of me, I ask that you be patient.}
>> ^{I will keep in touch, and keep you updated as time goes on. If you want an update if I haven’t given you one, feel free to request as such, and I will send you the current progress or an update on what is going on that is preventing me from working.}

>Payment plans are available for commissions that cost more than 150$USD.

>> ^{Payment plans will be discussed on a case by case basis, and the timeframe allowed, as well as the amount to be paid, will be decided on at the time we discuss the plan.}
>> ^{I will not finish a commission that has been put on a payment plan until the full price has been paid.}
>> ^{If you cancel your commission without paying the full amount, you will only be refunded 50% of the amount paid.}
>> ^{If the piece or design has been started, and you cancel your commission, no refund will be offered.}

>Limited/Minor Corrections on Commissions whose status has reached Completed will be allowed for a SHORT PERIOD OF TIME.

>> ^{Limited/Minor Corrections are allowed within 24hrs of the Commission being Completed.}
>> ^{Corrections will only be for small details; IE if I missed scars or markings. Or if there are slight color changes that you wish to have made.}
>> ^{Any changes Requested past the 24hr mark, will be rejected.}

>I Reserve the Right to use discarded designs.

>> ^{This means any thumbnail or pose that the Client, or Customer, do not choose for their commission I may complete or use for items such as YCHs or other means that I choose.}

Anywhere you post my artwork, I must be credited. No exceptions.

You may not claim my artwork as your own and/or having been done by you. Doing so will count as art theft and will result in immediate blacklisting and further actions on my end.

Custom Designs & Character Sheets

All custom designs are my interpretation of a given concept. I will do my best to match your description but understand it may not be the same as what you have within your mind. The more details I am given the closer the reflection of that image will be, and it will help refine the final product to your desired outcome.

>> ^{While working on Custom designs, I will be providing updates and points where edits are available.}

>The customer will be provided with concept sketches of both base pose/anatomy and intended markings/colors. The customer may request edits during these stages to those respective portions of the design.

>> ^{When offered the Pose/Anatomical Sketch, the Customer may request edits to the pose as well as any portion of the character’s physical body.}
>> ^{When given the intended Marking & Color update, the Customer may make requests to the color palette as well as any intended changes to the markings of the character.}

>Once the Sketches/Poses, Anatomy, Markings, and Palette are approved by the customer, no further edits may be requested and the design will be considered finalized before continuing with the commission.

>> ^{Minor edits may be allowed but are subject to my discretion.}

>If you are requesting a design for an ARPG species, you must provide the specifications for that species. You will be responsible for meeting the requirements for meeting that ARPG’s guidelines or owning the items to make it.

>I will create fandom characters, (i.e. Wings of Fire, Legends of Spyro, as well as other games, shows, books, and comics), but they must be your own unique concept.

>> ^{Please keep in mind that even when requesting Fandom OCs, they will still be rendered in MY unique style even if I will make efforts to make the designs closer to the aesthetic of the Fandom.}

>I will not make designs based on existing OCs, (unless they are your own), or existing fandom characters. Any concepts provided must be unique and based on your own ideas.
>If you have a character site such as Toyhouse, you must list me as either a creator or designer of the finished design to prevent art theft in case of selling the design or transfers.

>I Reserve the Right to use discarded designs.

>> ^{This means any design that the Client, or Customer, do not choose to keep for themselves I may complete and sell or use the discarded designs.}

Payment

All purchases are to be paid in, or the equivalent of, USD.Upon the ordering of a commission or custom design, half of the agreed upon payment is due before any work is to start. Following that payment, the Commissioner will begin working upon the Customer’s order.Acceptable Payment Method(s): Currently Paypal only. I, the Commissioner, will be looking at other methods at a later date. If there are any suggestions, please feel free to offer them.
